No, marrying a United States citizen, or lawful permanent resident does not automatically give a foreign-national spouse a “green card.” Simply getting married will not allow the foreign-national to stay in the United States as a lawful permanent resident. A formal Marriage Based Green Card Petition Form I-130, and an Application for Adjustment of Status Form I-485 (when the foreign-national spouse is living in the U.S.) or an immigrant visa petition(when the foreign-national spouse is living outside the U.S.) must be completed.
Is there a limit on the number of Marriage Green Cards issued each year?
If you are married to a United States citizen then you will qualify as an “immediate relative.” This means that there are no limits to the number of marriage green cards issued each year. However, if you are married to lawful permanent resident (green card holder) then there are more restrictions on the number of marriage green cards issued each year. In this case you would qualify as Second Preference 2A Immigrant. Currently there is a 2 year waiting period for this category of family based green cards.
